Buying a new home can be one of the largest and most important financial transactions of your life. Homeownership is part of the American dream, and it’s one that can be a reality for you.

However, there are a variety of pitfalls that potential homeowners can run into as they navigate this process. To help ensure that you don’t get yourself – or your family – into a sticky situation when buying a new home, it’s a good idea to consult a lawyer throughout the process.

1. Providing consultation before you sign a purchase agreement or sales contract. There is the potential to give up valuable legal rights when you sign these documents, or to get trapped in fine print that outlines financing agreements you don’t fully understand.

2. Getting a mechanical and structural inspection by a professional. A lawyer can draw up a contract specifying that there be an inspection satisfactory to you as the buyer and that permits you to cancel the agreement to buy if it is not satisfactory.

3. Putting everything in writing. Don’t accept oral assurances from real estate agents or sellers. Make sure any essential information is put in writing. Otherwise it can be difficult to enforce.

4. Checking in on zoning laws. Your neighborhood may not be zoned strictly for residential use, which is something you want to know before you move in. Your lawyer can research the local zoning laws and make sure you clearly understand them.

5. Performing a title search. This process ensures that all issues with the property are fully stated so there are no surprises. This is arranged by the attorney and often conducted by a third party.

6. Completing the deed correctly. The wording of this document needs to be perfect to prevent future property ownership or transfer problems.

7. Making sure sellers understand what repairs are required.  If the seller agrees to make repairs before selling you the home, this needs to be clearly communicated in writing. This prevents confusion if the seller doesn’t follow through.
